6. PRICE ADJUSTMENT:
Ash: A penalty or premium of 1% will apply to the FOB Price,

above or below 9.5%, as determined by the aggregate final analysis,
on an ARB.
Moisture: A penalty or premium of 1.0% will apply to the FOB
Price, for each 1.0% (or fraction pro-rate) movement in the
moisture content above or below 8.5%, as determined by the
aggregate final analysis, on an ARB.
Sulfur: A penalty or premium of 1.0% will apply to the FOB
Price for each 0.*0% (or fraction pro-rate) movement in the sulfur
content above or below 0.*7%, as determined by the aggregate final
analysis, on an ARB.
Volatiles: A penalty or premium of 1.0% will apply to the FOB
Price, for each 1.0% (or fraction pro-rate) movement in the
volatile matter above or below *2.0%, as determined by the
aggregate final analysis, on an ARB.
7. CONDITIONS OF CONTRACT & TERMS OF PAYMENT
Trial shipment contract, Documentary Letter of Credit, at
sight, non-transferrable, confirmed clean and clear and divisible
and payable against presentation of original BL.

9. WEIGHT DETERMINATION/ DRAFT SURVEY:
Weight to be determined by draft survey at loading port and to
be performed by an independent surveyor. The result of this draft
survey shall be final and binding unless of manifest error. Cost
for Sellers account.

*1. RISKS AND PROPERTY:
Title and risk of the Coal shall pass to the Buyer, as the
Coal passes the vessel's rail at the loading port.
*2. DESTINATION:
The buyer shall include the fate of coking coal in the LOI and
the final contract.

7 days.
